FL v GA, US Supreme Court

Special Master Paul Kelly, Jr. will heard oral arguments on November 7, in the FL v GA case in the US District Court of New Mexico. The US Supreme Court appointed the case to Kelly last summer. Retired Riverkeeper, Dan Tonsmeire attended the recent hearing.

September 2019 update:

The oral arguments have been changed. Oral argument is set to commence at 10 a.m. Nov. 7, at the U.S. District Courthouse for the District of New Mexico, in Albuquerque.

August 4, 2019 update:

This legal case over water use in the Apalachicola-Chattahoochee-Flint Rivers system remains in play. The case was assigned to Special Master Paul J. Kelly, Jr. by the U.S. Supreme Court after the SCOTUS June 2018 ruling for further consideration. In early 2019, the State of Florida requested oral arguments before special master Paul Kelly.

On July 29, 2019:

“The Special Master hereby grants the motion for oral argument as follows: Oral argument will commence on Monday, December 16, 2019, at 10:00 am. The location is the United States District Court for the District of New Mexico, 333 Lomas Blvd. NW, Albuquerque, New Mexico, Chama Courtroom, Fourth Floor. Each party will be allotted 45 minutes, and Florida may reserve time for rebuttal.”

Separately, Apalachicola Riverkeeper’s legal challenge to the Corps’ of Engineers’ water control manual  also remains in play in the U.S. District Court.
